1. Aceptación de los términos

STIGMA es una aplicación de citas. Al crear una cuenta o utilizar la aplicación, el usuario acepta estos términos y la Política de privacidad. En caso de no estar de acuerdo, deberá abstenerse de utilizar STIGMA.

2. Requisitos para el uso

Para crear una cuenta y utilizar STIGMA, el usuario debe cumplir con las siguientes condiciones:

• Mayoría de edad: ser mayor de 18 años.
• Identidad real: ser una persona física real y proporcionar información verdadera, exacta y actualizada. Cada persona puede tener una sola cuenta.
• Correo electrónico: contar con una dirección de correo electrónico válida, que se utilizará para verificar y respaldar la cuenta.
• Cuenta habilitada: no haber sido suspendido o expulsado de STIGMA con anterioridad, ni tener prohibido el uso del servicio por disposición legal.

3. Funcionamiento de STIGMA

• Selection: se muestran perfiles según edad, género y ubicación, en cantidades limitadas que se renuevan cada 6 horas.
• Matches y Regla de las 72 horas: cuando se produce un match, uno de los usuarios debe escribir primero dentro de las 24 horas y el otro debe responder dentro de las 48 horas siguientes. De no cumplirse, el match vence y puede restar estrellas de reputación a quienes corresponda conforme a la regla.
• Reputación: el ranking de estrellas se calcula a partir de calificaciones opcionales y secretas entre usuarios y de la Regla de las 72 horas. Se muestra una vez alcanzado un mínimo de 3 calificaciones.
• Etiqueta de Belleza: es un indicador automático generado mediante un análisis facial de la selfie de verificación. No constituye una evaluación objetiva ni un juicio sobre el valor de la persona. El tratamiento de la selfie se detalla en la Política de privacidad.
• Modo HYPE y Premium: funciones de pago que otorgan mayor visibilidad y beneficios adicionales.

4. Verificación

La verificación del perfil es opcional, pero resulta necesaria para contratar Premium. La selfie se analiza en el dispositivo del usuario, no se almacena y nunca se muestra en el perfil.

5. Conducta y uso aceptable

Está prohibido acosar, amenazar o discriminar; publicar contenido ilegal, sexualmente explícito o perteneciente a terceros sin su autorización; suplantar identidades; crear perfiles falsos; utilizar la aplicación para vender, publicitar o estafar; así como intentar vulnerar la aplicación o sus sistemas, incluida la introducción de virus o cualquier otro material dañino.

6. Contenido del usuario

El usuario conserva la titularidad de sus fotografías y textos. Otorga a STIGMA una licencia limitada, no exclusiva y gratuita para mostrarlos dentro de la aplicación mientras su cuenta permanezca activa. El usuario declara tener derecho a publicarlos.

7. Propiedad intelectual

El diseño, los textos, los gráficos, el logotipo y el funcionamiento de STIGMA están protegidos por las leyes de propiedad intelectual. Queda prohibido copiarlos, distribuirlos o utilizarlos sin autorización expresa.

8. Reportes, bloqueos y suspensiones

El usuario puede cancelar un match, bloquear o reportar a otra persona desde el chat. STIGMA podrá suspender o cancelar las cuentas que incumplan estos términos, incluso de forma automática cuando reciba reportes de varios usuarios distintos.

9. Suscripciones y pagos

Los pagos se procesan a través de PayPal. El precio, la duración, la renovación y la cancelación de cada plan se informan en la aplicación antes de la contratación. Los reembolsos se rigen por la ley aplicable y por las condiciones del plan contratado.

10. Seguridad del usuario

Al conocer a otras personas, se recomienda tomar precauciones: no compartir datos financieros, reunirse en lugares públicos e informar a una persona de confianza. STIGMA no verifica los antecedentes de los usuarios.

11. Limitación de responsabilidad

STIGMA se ofrece en el estado en que se encuentra, sin garantía de obtener matches ni citas. En la medida que la ley lo permita, STIGMA no es responsable por la conducta de los usuarios ni por los daños indirectos derivados del uso de la aplicación.

12. Terminación

El usuario puede eliminar su cuenta en cualquier momento desde Configuración. STIGMA podrá suspender o cerrar la cuenta en caso de incumplimiento.

13. Modificaciones

STIGMA podrá actualizar estos términos. Si el cambio es relevante, se notificará dentro de la aplicación. El uso de STIGMA posterior a la modificación implica su aceptación.

14. Ley aplicable y contacto

Estos términos se rigen por las leyes de la República Argentina. Cualquier controversia será resuelta por los tribunales competentes, sin perjuicio de los derechos que la ley reconoce a los consumidores. Consultas: stigma.datingapp@gmail.com.

1. Acceptance of the Terms

STIGMA is a dating application. By creating an account or using the application, the user accepts these terms and the Privacy Policy. If the user does not agree, they must refrain from using STIGMA.

2. Requirements for Use

To create an account and use STIGMA, the user must meet the following conditions:

• Legal age: be over 18 years of age.
• Real identity: be a real natural person and provide truthful, accurate and up-to-date information. Each person may have only one account.
• Email address: have a valid email address, which will be used to verify and back up the account.
• Account in good standing: not have been previously suspended or expelled from STIGMA, nor be prohibited by law from using the service.

3. How STIGMA Works

• Selection: profiles are shown according to age, gender and location, in limited numbers that are renewed every 6 hours.
• Matches and the 72-Hour Rule: when a match occurs, one of the users must write first within 24 hours and the other must reply within the following 48 hours. Otherwise, the match expires and may deduct reputation stars from whoever is responsible under the rule.
• Reputation: the star ranking is calculated from optional, secret ratings between users and from the 72-Hour Rule. It is displayed once a minimum of 3 ratings has been reached.
• Beauty Tag: an automatic indicator generated through a facial analysis of the verification selfie. It is not an objective evaluation or a judgment of a person's worth. The handling of the selfie is detailed in the Privacy Policy.
• HYPE Mode and Premium: paid features that provide greater visibility and additional benefits.

4. Verification

Profile verification is optional, but it is required to subscribe to Premium. The selfie is analyzed on the user's device, is not stored, and is never shown on the profile.

5. Conduct and Acceptable Use

It is prohibited to harass, threaten or discriminate; to post illegal or sexually explicit content, or content belonging to third parties without their authorization; to impersonate others; to create fake profiles; to use the application to sell, advertise or defraud; and to attempt to compromise the application or its systems, including introducing viruses or any other harmful material.

6. User Content

The user retains ownership of their photographs and texts. The user grants STIGMA a limited, non-exclusive, royalty-free license to display them within the application while their account remains active. The user declares that they have the right to publish them.

7. Intellectual Property

The design, texts, graphics, logo and operation of STIGMA are protected by intellectual property laws. Copying, distributing or using them without express authorization is prohibited.

8. Reports, Blocks and Suspensions

The user may cancel a match, and block or report another person from the chat. STIGMA may suspend or cancel accounts that breach these terms, including automatically when it receives reports from several different users.

9. Subscriptions and Payments

Payments are processed through PayPal. The price, duration, renewal and cancellation of each plan are shown in the application before purchase. Refunds are governed by applicable law and by the terms of the plan purchased.

10. User Safety

When meeting other people, it is recommended to take precautions: do not share financial information, meet in public places and let a trusted person know. STIGMA does not verify users' backgrounds.

11. Limitation of Liability

STIGMA is provided "as is", with no guarantee of obtaining matches or dates. To the extent permitted by law, STIGMA is not responsible for users' conduct or for indirect damages arising from the use of the application.

12. Termination

The user may delete their account at any time from Settings. STIGMA may suspend or close the account in case of breach.

13. Modifications

STIGMA may update these terms. If the change is significant, notice will be given within the application. Continued use of STIGMA after the modification implies acceptance.

14. Governing Law and Contact

These terms are governed by the laws of the Argentine Republic. Any dispute will be resolved by the competent courts, without prejudice to the rights that the law grants to consumers. Inquiries: stigma.datingapp@gmail.com.
